Can I Write "FDA Approved" on my cosmetic product label?
The U.S. Food and Drug Administration (FDA) does not "approve" cosmetic products in the same way it does with drugs or medical devices. Instead, the FDA regulates cosmetics under the Federal Food, Drug, and Cosmetic Act (FD&C Act). Cosmetic products and their ingredients are not subject to pre-market approval by the FDA.
However, the FDA does require that cosmetics be safe for use and properly labeled. If your cosmetic product meets the regulatory requirements, you can generally market and sell it without FDA approval. The responsibility is on the cosmetic manufacturers to ensure the safety of their products and to adhere to labeling regulations.
That said, there are certain restrictions and requirements for cosmetic labeling, and misleading claims, including false statements about FDA approval, could lead to regulatory action. It's crucial to comply with the FDA regulations regarding cosmetic labeling and advertising.
